Title: Decision on Accural Answer Postponed
Post by: Buzz on June 08, 2020, 10:38:22 PM
We were supposed to hear one way or the other about summer accrual after today's EB conference. The contractors are stalling the answer until Wednesday. I'll let you know as soon as I hear, of course.

If the answer is "No" the union vows they will seek arbitration immediately. (That doesn't mean it will happen immediately, it's dependent on the schedule of the arbitrator.)

Why the stall, what benefit do they gain by delaying their decision to pay the accural? Buzz, thanks again for keeping us up to date, as much as possible.

Supposedly they're saying if the city pays them for April they will pay the accrual.

But if the city hasn't paid them in 2 months, what are the chances they'll pay them in 2 days?

I hope it doesnt come down to arbitration bcz we need our money now. Im.sure we are all in the same boat. Once that unemolyment goes back to normal well have nothing to fall back on to pay our bills.

Just got a call from Ernie. The union is not waiting for tomorrow. The contractors are not going to pay the accrual AT THIS TIME. They say they will eventually, but the union is NOT waiting for that to happen and is filing for arbitration IMMEDIATELY.

Sorry to give you the bad news.

Anyone care to venture a guesstimate on when the arbitration for the accrual payment might come to fruition...

Dependent upon the arbitrator's schedule. Let you know when I hear.

(And how long the other side is able to delay it by saying they can't make it on this or that date for whatever reason.)

Would this decision on arbitration of accrual come before or after the date Pioneer would expect me to resume my duties as a bus driver? I raise this question, because I for one would be reluctant to drive till this arbitration is settled.

I pray we at least get the money by the time unemployment goes back down bcz i for one wont be able to pay my bills through the rest of the summer without it.

According to Ernie, that will be a topic of the arbitration also.

I'm pretty sure we would get it before we went back to work because I doubt these companies would resume operations without getting the money they are owed by the city ... and they have said that is the only reason they are not paying now. The union's position is they have to pay it now regardless and thus the basis for arbitration.

I have to disagree with you. The second school is ready to reopen so will Neil. He'll fight for what the City owes him but he's not going to let that stop him from makings (grossing) 8 or 9 million a month!

So you're saying he would open without getting the back money owed? You might be right, but I think the coalition would stick together and demand payment before providing service. They already got burned by the city once. They're no fools.

I don't think they're gonna let themselves get burned again. If the City contacts the contractors and says we're going to resume classes in September, I'm sure the contractors will make sure they receive payment for September by the last day of August and so on for every month following even if they have settled on April or any other months they believe are owed to them. They will go to arbitration or court if they didn't already for that money and just wait for a decision. As I said I seriously doubt that they would jeopardize the remaining part of their multimillion dollar contracts. That's like saying if schools were to reopen in September and the Neil and the other contractors were to agree to reopen that 1181 is going to say that it's members are not coming back unless we get are accrual checks first (that's assuming that we didn't already get them). Of course not, we'll return to work and wait as long as it takes for arbitration.

In my last comment I meant to say even if they "haven't" settled on April. Not "have"
