Training Attestation & Pay

This morning in my bank account through direct deposit I received two checks. One for my sick days (5 for me since I didn't use any during the year) and one for the last week of school (40 hrs reg. pay & any run coverage that I did the last week of school).
I was also expecting 15 hours pay for the video training that I did on 6/6, 6/20 and 6/21 that I signed for and handed in an attestation form on 6/23/26. I DID NOT receive those 15 hours.
Did any one receive their pay for the Videos?

Just got the same as you. I'll get an answer as to when we should expect the training pay.

Not really. All I know is we're only getting 6 hours for the defensive driving ... because "that's what every body else is paying" and our union has no balls ... and I'm waiting to hear as to when we might expect to get that. When I know, you'll know.

I guess the apple doesn't fall far from the tree. Because if the Union has no balls neither does the majority of its Members. As per our contract, we should all be getting paid more than six hours for that video and we should all have gotten paid today for all three videos. I'm ready to march into the Union office (not the Shop Steward office), the Union Office next week. Now let's see who has balls? Who's coming?
And don't give me that BS response it won't make a difference. Obviously, it won't make a difference if I go by myself, but if I go there with 30 guys, it will make a difference!

By the way ... when we do get paid (and we will) ... I'm told it will paid over 2 weeks so that no one week is more than 10 hours so as not to interfere with unemployment.

That's just a crock of shit. We all ALREADY know we will get paid.
How do we know because it's the law. We worked and he has to pay us.
And we all ALREADY know it won't interfere with our unemployment. It doesn't have to be split up in two payments such as 10 hours and 4 hours.
Reason being when you file for unemployment and someone correct me if I'm wrong but when you file doesn't Unemployment ask you how many hours did you WORK THIS WEEK or did you collect holiday pay, etc..
So when you say you didn't work or collect holiday pay, you're not lying.
And even if I am wrong in my thinking I'm sure that Pioneer is not going to deny anyone full unemployment if we get a 14 hour check.
But we're getting off the point here.
The point is the contract says we should get paid at least 6 1/2 hours for the defensive video and the law says we should have gotten paid for all 3 videos no later than today!
I wish someone would grow a pair and take a ride with me to the Union Hall.
WTF are we in a Union for and pay dues for?

You are getting paid "X" number of hours. Call it whatever you want, but if it's over 10 hours you have to say so because it is PAY and your benefit will be adjusted accordingly. It is not up to Pioneer. It is to our benefit not to be paid all at once.


Wondering what you're referring to when you say, "the law says we should have gotten paid for all 3 videos no later than today!?" What law says when you must be paid? (Just asking.)

First off, with regards to the splitting of the 14 hours I said correct me if I'm wrong and I'll find out Sunday morning when I hear the "exact wording" when I apply for my weekly benefit.
And I don't know how Unemployment works, but I'm sure it is definitely up to Pioneer, otherwise if Unemployment doesn't contact Pioneer to see if Buzz or Proud Member worked or got paid for a specific week then Buzz or Proud Member can put in for Unemployment every week want whether they work/got paid or not.
As far as the law with regards to getting paid it's NYS Labor Law 191 and it explicitly says and I quote
" ALL HOURS WORKED WITHIN A SINGLE WORK WEEK—
WHETHER SPENT DRIVING THE BUS OR WATCHING A REQUIRED VIDEO—ARE PART OF THAT WEEK'S TOTAL WAGES AND MUST BE PAID TOGETHER ON YOUR NEXT WEEKLY PAYCHECK.

Pioneer determines whether or not you are entitled to unemployment benefits ... not how much your benefit should be.

Regarding the labor law, many such laws are superseded by collective bargaining agreements. Although this is not specifically addressed in the CBA their "out" could be that it was not part of that week's wages being the sessions were on non-work days. Not saying that is so, just a possibility.

Look at ur paychecks
Work weeks are from Monday to Sunday
NOT Monday to Friday

I could be wrong but the way I read this, you just proved my point.
It clearly states
"how many days did you WORK, including self-employment,during the week ending (date)?"
As I said during the week that I'm claiming even though I'm getting PAID from the company for 14 hours, we didn't WORK 14 hours. So in my opinion we're telling the truth when we check off 0-10.
Again we're getting away from the point.
Bottom line, regardless if we're going to get paid (which obviously we will), we should have gotten paid for all the videos yesterday and the first video should be for 6 1/2 to 7 hours. NOT 6 hours.

Splitting hairs. You're getting paid for 14 hours of WORK whether you actually worked or not.
